This agreement is made between the owners and the guests of the St. Joe River Retreat.
THE PARTIES AGREE AS FOLLOWS:
1. OWNER shall grant full use of rental home and property at 345 Milwaukee Road in Avery, Idaho for the prospective dates, upon confirming the reservation and the receipt of all applicable charges.
2. REFUNDS will be made only when a cancellation is requested 60 days before scheduled arrival. All funds received will be returned less a $50 cancellation fee. In the event that cancellation is requested within 60 days $500.00 will be forfeited to the owner and a $50 cancellation fee will be charged. Remaining funds paid will be returned to guest.
EXCEPTION: Because road and snow conditions are not predictable in the winter months cancellations will be accepted if made 2 days prior to scheduled arrival when winter rates are in affect. Should winter conditions prohibit the guest’s use of the property full refunds will be granted aside from a $50 transaction fee.
3. BEDDING, towels, home, and kitchen supplies are provided for the guests.
4. LONG DISTANCE CALLS ARE FREE provided they are within the United States. Any additional phone charges incurred during the period of possession shall be deducted from the security deposit.
5. SMOKING is not permitted inside the home.
6. GUEST agrees to maintain the home in the condition it was in at the time he took possession and to assume responsibility for any loss or damage beyond normal wear and tear. GUEST shall leave the cabin and property in a clean condition.
7. PETS are welcome although you MUST clean up after your pet and maintain control of your pet at all times. NEVER leave your dog unattended. If you are leaving for the day you must take your dog with you. Any complaints from neighbors regarding excessive noise or other nuisances may be cause for immediate termination of the lease and forfeiture of the tenant's entire security deposit.
8. SLEEPING CAPACITY/DISTURBANCES: Tenants and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: A.) Occupancy exceeding the sleeping capacity stated on the reservation confirmation. B.) Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age. C.) Causing damage to the premises rented or to any of the neighboring properties. D.) Any other acts which interferes with neighbors' right to quiet enjoyment of their property.
9. HOLD HARMLESS: The owners do not assume any liability for loss, damage or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing. Nor will the owners accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond its control.
10. IN THE EVENT that guest breaches any of the terms/conditions of this agreement, the owner shall be entitled to attorney's fees and or damage deposits in any action brought to enforce these terms.
11. GUEST shall not assign this Agreement or sublet the home.
12. CHECK IN TIME IS 3:00 PM, CHECK OUT TIME IS 10:00 AM unless prior arrangements have been made.
